Acceptance of Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and StatusPulse ("we," "us," or "our") governing your access to and use of the StatusPulse platform, including all related websites, applications, and services (collectively, the "Service").
By creating an account, accessing, or using the Service in any manner, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Service.
If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms, and "you" refers to both you and that organization.
Description of Service
StatusPulse provides a software-as-a-service (SaaS) platform for website and infrastructure uptime monitoring. The Service includes:
- Automated HTTP/HTTPS uptime monitoring with configurable check intervals
- SSL certificate expiry tracking and alerts
- Real-time incident detection and management
- Multi-channel alerting via email, SMS (where enabled), webhooks, and third-party integrations including Slack, Discord, Microsoft Teams, and Telegram
- Customizable public-facing status pages with custom domain support
- Incident history, reporting, and CSV data export
- Analytics and response-time performance data
We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice. We are not liable to you or any third party for any modification, suspension, or discontinuation of the Service.
Accounts & Registration
Account Creation
To access most features of the Service, you must register for an account. You agree to provide accurate, current, and complete information during registration and to keep this information up to date.
Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:
- Use a strong, unique password for your account
- Notify us immediately of any unauthorized use or security breach
- Not share your credentials with any third party
- Log out of your account at the end of each session when using shared devices
We are not liable for any loss or damage arising from unauthorized access to your account that results from your failure to safeguard your credentials.
Account Eligibility
You must be at least 18 years of age to create an account. By registering, you represent that you meet this age requirement.
Subscriptions & Billing
Subscription Plans
StatusPulse offers various subscription plans with different features and usage limits. Details of current plans, including pricing and included features, are available on our pricing page. Plan features and pricing are subject to change with notice.
Billing
By subscribing to a paid plan, you authorize us to charge your payment method on a recurring basis (monthly or annually, depending on your selected plan). All charges are in the currency shown at checkout. Prices are exclusive of taxes unless stated otherwise.
Renewals & Cancellation
Subscriptions automatically renew at the end of each billing period unless cancelled before the renewal date. You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period — you will retain access to paid features until that date.
Refunds
All subscription fees are non-refundable except as required by applicable law. We do not provide pro-rated refunds for unused portions of a subscription period.
Free Plans & Trials
Where offered, free plans or trial periods are subject to additional terms communicated at sign-up. We reserve the right to modify or terminate free plans at any time.
Payment Processing
Payments are processed by third-party payment processors (including Stripe). Your payment information is subject to the processor's own privacy policy and terms. We do not store your full payment card details.
Acceptable Use
You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not use the Service to:
- Monitor websites or services without authorization from the respective owner
- Conduct or facilitate any illegal activity
- Transmit any content that is unlawful, harmful, defamatory, or objectionable
- Attempt to probe, scan, or test the vulnerability of the Service or its infrastructure
- Circumvent any authentication or security measures
- Use automated means to access the Service in a manner that exceeds reasonable usage or burdens our infrastructure
- Resell or sublicense access to the Service without our written consent
- Impersonate any person or entity
We reserve the right to suspend or terminate accounts that violate these acceptable use provisions.
Intellectual Property
The Service, including its design, software, text, graphics, logos, and other content, is owned by or licensed to StatusPulse and is protected by copyright, trademark, and other intellectual property laws.
We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service solely for your internal business purposes in accordance with these Terms. This license does not permit you to:
- Copy, modify, or create derivative works of the Service
- Reverse engineer or decompile any part of the Service
- Remove any proprietary notices or labels
- Use the Service to build a competing product or service
Any feedback, suggestions, or ideas you provide regarding the Service may be used by us without obligation to you.
Your Data
You retain ownership of any data, content, or configurations you input into the Service ("Your Data"). By using the Service, you grant us a limited license to store, process, and use Your Data solely to provide and improve the Service.
We implement commercially reasonable technical and organizational measures to protect Your Data. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security.
Upon termination of your account, Your Data will be retained for a limited period as described in our Privacy Policy, after which it will be deleted. You are responsible for exporting any data you wish to retain before account closure.
Service Availability
We strive to maintain high availability of the Service, but we do not guarantee uninterrupted or error-free operation. The Service may be temporarily unavailable due to:
- Scheduled maintenance (we aim to provide advance notice)
- Unplanned outages or technical failures
- Events beyond our reasonable control (force majeure)
- Actions of third-party service providers
Monitoring accuracy depends on the availability and performance of our monitoring infrastructure and the accuracy of network connectivity to monitored endpoints. Check results may be delayed or unavailable during Service disruptions.
Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:
- Implied warranties of merchantability and fitness for a particular purpose
- Warranties that the Service will be uninterrupted, timely, secure, or error-free
- Warranties regarding the accuracy or completeness of monitoring results
- Warranties that defects will be corrected
You use the Service at your own risk. StatusPulse monitoring results are informational and should not be your sole basis for business-critical decisions.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL STATUSPULSE, ITS DIRECTORS, EMPLOYEES, PARTNERS, OR AGENTS BE LIABLE FOR ANY:
- Indirect, incidental, special, consequential, or punitive damages
- Loss of profits, revenue, data, business, or goodwill
- Damages resulting from missed or delayed monitoring alerts
- Damages exceeding the fees paid by you to StatusPulse in the three months preceding the claim
These limitations apply regardless of the legal theory under which damages are sought, and even if StatusPulse has been advised of the possibility of such damages.
Termination
Either party may terminate the agreement formed by these Terms at any time. You may terminate by cancelling your subscription and closing your account. We may suspend or terminate your access immediately and without prior notice if:
- You breach any provision of these Terms
- We are required to do so by law
- We discontinue the Service
- Your account shows no activity for an extended period
Upon termination, your right to access the Service ceases immediately. Provisions of these Terms that by their nature should survive termination (including intellectual property, disclaimer, limitation of liability) will survive.
Governing Law
These Terms are governed by and construed in accordance with applicable law. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts in the jurisdiction where StatusPulse is registered.
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
Changes to Terms
We may update these Terms from time to time. When we make material changes, we will notify you by email and/or by displaying a prominent notice in the Service. The updated Terms will indicate the revised effective date.
Your continued use of the Service after any changes take effect constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Service.
